LingoVik · Legal
Terms of Service
The agreement between you and LingoVik: who can use the app, accounts, subscriptions, fair use, content, and what happens if something goes wrong.
In short
- LingoVik is a language-learning web app for adults: you must be 18 or older.
- The app is a Beta version. Some content is made with AI and can contain mistakes.
- Paid plans are sold by our reseller Paddle. There is a 7-day free trial, and you can cancel at any time.
- Use LingoVik fairly: no misuse, no illegal content, and no copying of our course content.
- Norwegian law applies, and you keep all your rights as a consumer.
This summary helps you read the document. The full text below is what applies.
1.About these terms
These terms of service (“terms”) are an agreement between you and [YOUR FULL NAME OR COMPANY NAME] (“LingoVik”, “we”, “us”). They apply when you use the LingoVik web app at lingovik.com or any other part of our service (the “service”).
By creating an account, you confirm that you have read and accept these terms. If you use LingoVik without an account, these terms also apply to that use. If you do not accept the terms, please do not use LingoVik.
Two more documents are part of our agreement with you: the Subscription and Refund Policy and the Beta and AI Notice. Our Privacy Policy and our Cookie and Storage Policy explain how we handle personal data.
We may offer these terms in other languages. The English version is the binding version: if a translation says something different, the English version applies.
2.Who we are
LingoVik is run by:
- Name: [YOUR FULL NAME OR COMPANY NAME]
- Address: [POSTAL ADDRESS], Norway
- Organisation number: [ORGANISATION NUMBER, if any]
- VAT (MVA) number: [MVA NUMBER, if registered for VAT]
- Email: support@lingovik.com (privacy questions: privacy@lingovik.com)
- Website: lingovik.com
3.Who can use LingoVik
- You must be 18 years or older to create an account and to use LingoVik.
- Give true information when you sign up, and keep it up to date.
- Your account is personal. Do not share it, sell it or let other people use it.
- LingoVik is for your own learning. You may not use it for business purposes, for example to resell access, without our written permission.
- We may not be able to offer LingoVik, or paid plans, in every country — for example because of sanctions or the rules of our payment provider. [LAWYER: check sanctions and export-control rules, e.g. for users in Iran]
4.A Beta service with AI-generated content
LingoVik is a Beta version. This means that it is ready to use, but we are still building and testing it. Features can change, move or be removed, and you may meet bugs or wrong information.
Some content in the app is made with AI and can contain mistakes. This includes, for example, example sentences, translations, exercises, grammar explanations, pictures, voices and grammar videos. Do not rely on LingoVik as your only source when it really matters, for example before an exam or an official language test.
Please report bugs and mistakes with the bug button (🐞) in the app, or email us at support@lingovik.com.
Currently, the app is available only as a web application. Mobile applications may be released in the future. Users will be notified when mobile versions become available.
Read more in our Beta and AI Notice.
5.Your account
- You can sign up with your Google account, or with your email address and a password. If you use email and password, you must confirm your email address.
- Keep your password secret, and do not use the same password for other services. You are responsible for what happens in your account, unless someone else misused it in a way you could not prevent.
- If you think someone else is using your account, tell us at once at support@lingovik.com.
- You can delete your account at any time in Settings → Account → Delete my account. See Ending the agreement.
6.What LingoVik offers
LingoVik helps you learn a language with short, regular practice. Today there are two courses:
- English → Norwegian: levels A1 to C1.
- Persian → English: levels A1 to B2. Higher levels are coming later.
Features include flashcards with spaced repetition, quizzes, grammar lessons, pronunciation practice, shadowing with YouTube videos, a short-video feed, mini games, progress statistics, and rewards such as GIFs.
The levels (A1–C1) follow the Common European Framework of Reference for Languages (CEFR) as a guide. LingoVik is not an official language test, and it does not give certificates. We cannot promise a particular learning result — that depends on many things, including how you use the app.
After the free trial, you need a paid subscription to keep using LingoVik, unless we have given you free access. [CONFIRM: is there a free plan, or free features, after the trial?]
7.Subscriptions, free trial and payment
Paddle is our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
Paddle handles payments, taxes, invoices, refunds and other payment questions. We handle questions about the app itself.
When you buy a subscription, you buy it from Paddle, and Paddle's Buyer Terms (opens in a new tab) apply to the purchase. These terms apply to your use of LingoVik.
- Plans: Monthly, USD 15 per month, or Annual, USD 150 per year.
- Taxes: VAT or sales tax is added according to the country you are in. The checkout shows the total price before you pay. [LAWYER: price display to consumers — see README]
- Free trial: 7 days. You need a valid payment method to start the trial, but nothing is charged during the trial. If you cancel before the trial ends, you pay nothing. If you do not cancel, the first payment is taken when the trial ends.
- Automatic renewal: your subscription renews every month or every year until you cancel it.
- Cancel at any time in Account → Subscription → Manage. You keep access until the end of the period you have paid for.
- Free access: we may give some users free access, for example for testing. Free access is personal and can have its own conditions, which we tell you about when we give it.
All the details — prices, the trial, renewal, cancellation, refunds and your right of withdrawal — are in our Subscription and Refund Policy.
8.Right of withdrawal and refunds
If you are a consumer, you have a legal right to withdraw from your purchase within 14 days (in Norwegian: angrerett).
We also offer a money-back promise: you can get a full refund if you ask within 14 days after your first payment. [CONFIRM: money-back promise] The Subscription and Refund Policy explains how both work, and how to ask for a refund through Paddle.
9.Acceptable use
When you use LingoVik, you must not:
- break the law, or help anyone else to do so;
- add, type or share content that is illegal, hateful, threatening, harassing, sexual or violent, or that can harm children;
- share personal information about other people — for example in cards, cheers or bug reports — without their permission;
- infringe other people's rights, such as copyright — for example by importing word lists or texts that you are not allowed to copy;
- try to get around payments, free-trial rules or limits — for example by opening several accounts to get more free trials;
- copy, download in bulk, scrape, sell or republish our course content, audio or pictures;
- use bots, scripts or other automated tools to use the service;
- try to break, overload or test the security of the service, or access accounts or data that are not yours;
- reverse engineer or copy the app's software, except where the law allows it;
- misuse the AI features (see AI features);
- send spam to other learners or harass them, for example through the friend features.
Have you found a security problem? Please tell us at support@lingovik.com, and do not use it or share it with others. We are grateful for responsible reports.
If you break these rules, we may remove content, limit features or suspend your account. See Ending the agreement.
10.AI features
Some features use AI services from other companies, such as Google Gemini, to create content from what you enter. For example, Quick add creates a card from a word you type, and the app can create exercises, grammar videos and audio overviews.
- You are responsible for what you enter. Only enter text that you have the right to use, and do not enter sensitive personal information — about yourself or about others.
- Do not misuse the AI features to create illegal content, sexual content about real people, “deepfakes”, hate, harassment, malware or spam, to deceive people, or to trick the AI into ignoring its safety rules (“jailbreaking”).
- Check the results. AI output can be wrong, incomplete or unsuitable. It is for language practice only and is not professional advice — for example legal, medical, financial or immigration advice.
- Rights to AI output: as far as the law allows, you may use the AI output you create in LingoVik for your own learning. Course content that we create with AI belongs to us (see Intellectual property).
- Moderation: we may review, change or remove AI-generated content, and limit or stop AI features, if they are misused, or to keep LingoVik safe and lawful.
To report AI output or other content that you think is illegal or breaks your rights, see Reporting content.
11.Your content
“Your content” is what you add to LingoVik yourself — for example cards you create or import, YouTube videos you add for shadowing, text you type into AI features, cheers you send, and bug reports.
- You keep your rights to your content.
- You give us permission (a licence) to store, copy, process, adapt and show your content, as far as we need to run, protect and improve LingoVik. The licence is free, worldwide and non-exclusive. It ends when your content is deleted, except for copies that we must keep by law, or that other learners have already received (see the next point).
- Shared with other learners: today, cards you add with Quick add or by CSV import, and YouTube videos you add for shadowing, become part of a shared collection that other learners can see and use. Do not put personal information in these items. [CONFIRM: keep this sharing for the public launch? If yes, say whether your name or user ID is shown with the item]
- You promise that you have the right to add your content, and that it does not break the law or these terms.
- We may remove content that breaks the law or these terms. When the law requires it, we tell you why.
- Feedback: if you send us ideas or suggestions, we may use them freely, without paying you.
12.Intellectual property
LingoVik — the name, logo, design, software and course content (the cards, sentences, lessons, exercises, audio, pictures and videos that we create, also with the help of AI) — belongs to us or our licensors and is protected by law.
We give you a personal, non-exclusive and non-transferable right to use LingoVik for your own learning while you have an account — and for paid features, while your subscription or free access is active. You may not copy, sell, rent, publish or share our content outside the app, except where the law allows it.
Some content belongs to others and is used under their terms: YouTube videos belong to their creators and are shown with YouTube's own player under YouTube's Terms of Service (opens in a new tab); photos come from Pexels, Unsplash and Pixabay under their licences; GIFs come from GIPHY. The owners keep their rights.
13.Reporting content
If you see something in LingoVik that you think is illegal or breaks these terms — for example content that infringes copyright — tell us at support@lingovik.com or with the bug button (🐞). Please tell us where the content is, why you think it is a problem, and how we can contact you.
We look at every report carefully and fairly, we act quickly when content is clearly illegal, and we tell you what we decided. If we remove or limit your content, we tell you why and how you can disagree. [LAWYER: EU Digital Services Act duties — see README]
14.Services from other companies
LingoVik uses services from other companies — for example Google for sign-in, YouTube for videos and Paddle for payments. When you use them, their own terms and privacy policies also apply. We choose these services with care, but we do not control them. Our Privacy Policy lists the services that receive personal data.
15.Availability, changes and support
- We work to keep LingoVik available and working well, but we cannot promise that it will always be available, without interruptions or free of errors — especially while it is a Beta version.
- We sometimes need to pause the service for maintenance, updates or security. When we can, we tell you in advance.
- We may change, add or remove features to improve LingoVik, for security, or for legal or technical reasons. If a change makes the paid service clearly worse for you, we tell you in good time, and you can end your subscription and get back what you paid for the time you have not used. [LAWYER: digitalytelsesloven §§ 41–42]
- Questions or problems? Email support@lingovik.com. We usually answer within [CONFIRM: number] working days.
16.Ending the agreement
If you want to stop
You can stop using LingoVik at any time. To end the agreement, delete your account in Settings → Account → Delete my account, or email us at support@lingovik.com.
If you have a paid subscription, please cancel it first in Account → Subscription → Manage. [CONFIRM: or make account deletion cancel the subscription automatically]
If we need to stop your access
We may suspend or close your account if:
- you seriously or repeatedly break these terms;
- a payment is not made;
- there is a risk of fraud, or a risk to the security of LingoVik or of other users;
- the law or an authority requires it.
When it is reasonable, we warn you first and give you a chance to fix the problem. If we close your account because you broke these terms, you are not entitled to a refund, unless the law says otherwise.
If we close LingoVik
If we decide to stop offering LingoVik, we tell you at least 30 days in advance when we can, and we refund what you have paid for the time after the service closes.
When the agreement ends, we delete your data as described in our Privacy Policy. The parts of these terms that by their nature should continue — for example on intellectual property and liability — still apply.
17.If something is wrong: your rights as a consumer
If LingoVik does not work as promised, you have rights under Norwegian consumer law — including the act on digital services for consumers (digitalytelsesloven) — and under the mandatory law of the country where you live. Depending on the problem, you can for example ask us to fix it, ask for a price reduction, end the agreement, or claim compensation.
Please tell us about the problem within a reasonable time after you notice it, at support@lingovik.com. Nothing in these terms limits your rights as a consumer.
18.Liability
We are responsible for loss that we cause by not keeping these terms, as Norwegian law provides.
As far as the law allows, we are not responsible for:
- loss caused by events outside our control that we could not reasonably have avoided — for example failures of the internet, of power, or of a service from another company that we depend on;
- indirect loss, for example lost income or lost time, unless we caused it by negligence;
- decisions you make based on content in the app, such as AI-generated content, when we have told you that it can contain mistakes.
If we are responsible and the law allows a limit, our total liability is limited to the amount you have paid for LingoVik in the 12 months before the event. [LAWYER: is this limit valid for consumers under Norwegian law?]
Nothing in these terms limits liability for death or personal injury, for loss we cause on purpose or by gross negligence, or any other liability that cannot be limited by law.
19.Changes to these terms
We may change these terms, for example when we add features, when the law changes, or to make them clearer.
If a change is important, we tell you by email or in the app at least 30 days before it takes effect. If you do not agree with the change, you can cancel your subscription and stop using LingoVik before the change takes effect. [LAWYER: check notice and consent rules for changes]
For changes that only help you, or that the law requires at short notice, we may give shorter notice.
The version and date at the top of this page show when these terms last changed. When you accept a version, we record which version you accepted, and when.
20.Law and disputes
Norwegian law applies to these terms. If you are a consumer and live in another country, you also keep the protection of the mandatory consumer laws of that country.
If you have a complaint, please contact us first at support@lingovik.com. Most problems can be solved quickly.
If we cannot agree, you can ask Forbrukerrådet (the Norwegian Consumer Council) for help and mediation at forbrukerradet.no (opens in a new tab). Some disputes can then be taken to Forbrukerklageutvalget (the Consumer Complaints Committee). If you live in another EU/EEA country, the European Consumer Centre in your country can also help. [LAWYER: confirm which bodies handle digital services and purchases made through Paddle]
You can also take the case to court. As a consumer, you can bring a case in the courts of the country where you live. Otherwise, the case goes to [CONFIRM: court, e.g. Oslo tingrett]. [LAWYER: Lugano Convention and choice of court]
